What Kind of Nationality Is This?
Nationality for grandchildren is considered original (originária) nationality, just like for children. That means once granted, you are recognized as Portuguese from birth — even though the process takes place later in life.
The procedure is done through attribution, not acquisition by naturalization, and it allows you to:
- Pass Portuguese nationality to your children;
- Keep it permanently (it cannot be revoked arbitrarily);
- Enjoy all rights and benefits of being an EU citizen.
What Does the Law Say?
The right to Portuguese nationality for grandchildren is provided under Article 1, no. 1, paragraph d) of the Nationality Law (Lei n.º 37/81). After the reform introduced by Law no. 2/2020, the process became more accessible – but still requires attention to detail.
To be eligible, you must prove:
- You are the grandchild of someone who was Portuguese at the time of your parent’s birth;
- Your parent (child of the Portuguese national) did not acquire Portuguese nationality (if they had, you might apply as a child instead);
- You have effective ties to the Portuguese community;
- You have not been convicted of a serious criminal offense;
- You are 18 or older, or legally emancipated.
What Are “Effective Ties to the Portuguese Community”?
This is perhaps the most delicate part of the process. While children of Portuguese citizens are presumed to be connected, grandchildren must prove it.
According to the law, effective connection can be shown through:
- Knowledge of the Portuguese language – usually proven by a certificate at A2 level or above (unless you’re from a Portuguese-speaking country with Portuguese as your mother tongue);
- Regular visits to Portugal;
- Property ownership, residence, or tax status in Portugal;
- Membership in Portuguese associations or cultural organizations abroad;
- Having other relatives with Portuguese nationality.
This is assessed on a case-by-case basis. Even if you speak Portuguese, it’s wise to combine that with additional proof of cultural or personal ties to Portugal.
What Documents Do You Need?
Here’s a general list of what you’ll need to submit:
- Your full birth certificate, identifying your parents;
- Your parent’s birth certificate;
- Your Portuguese grandparent’s birth certificate, or proof of nationality at the time;
- Proof of connection to Portugal (see above);
- A valid language certificate (A2 level), if required;
- Criminal record certificates from every country you’ve lived in since age 16;
- Your passport or ID;
- A signed declaration confirming your will to be Portuguese;
- Power of attorney, if you’re working with a legal representative.
Important note on foreign documents:
All documents not issued in Portugal must:
- Be less than 6 months old at the time of submission;
- Be translated into Portuguese by a certified translator, if not originally in Portuguese;
- Be apostilled under the Hague Convention (Apostila de Haia) or legalized by the Portuguese consulate.
Where to Apply
Applications can be submitted:
- At the Central Registry Office (Conservatória dos Registos Centrais) in Lisbon;
- Through a Portuguese consulate in your country of residence.
Processing times typically range between 12 to 24 months, but this may vary depending on the volume of applications and complexity of your case.
Language Requirement: What to Expect
One of the most critical steps in this process is proving you speak Portuguese. Unless you’re a national of a Lusophone country where Portuguese is your first language (like Brazil, Angola, or Mozambique), you will need to provide a certified language certificate at A2 level.
This can be obtained from accredited institutions such as:
- CAPLE (Centro de Avaliação de Português Língua Estrangeira)
- Portuguese universities with recognized testing centers
